Terms of Service

1. Acceptance of Terms

By accessing or using the Imbue Lang platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

You must be at least 13 years of age to use the Service. If you are located in the European Union, you must be at least 16 years of age. By using the Service, you represent and warrant that you meet the applicable age requirement.

2. Service Description

Imbue Lang is an AI-powered language learning platform that helps users learn languages through comprehensible input. The Service generates reading passages, vocabulary flashcards, grammar explanations, images, and audio using artificial intelligence. Imbue Lang currently supports Chinese, Japanese, German, French, Spanish, English, and other languages.

3. Account Registration

To use the Service, you must create an account by providing a valid email address, username, and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Billing

Imbue Lang offers paid subscription plans (Standard and Premium) with monthly and annual billing options. All payments are processed by Stripe (“Stripe”), our payment processor. Stripe handles payment processing, billing, and invoicing on our behalf. Imbue Lang is the seller of record and is responsible for applicable sales tax and VAT compliance.

  • Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.
  • We may change subscription prices with at least 30 days' prior notice. Price changes will take effect at the start of your next billing period.
  • You can manage your subscription, update payment methods, and view invoices through the Stripe billing portal.

5. Credit System

The Service uses a credit-based system. Each content generation action (passage, image, or audio) costs one credit. Your subscription includes a monthly credit allocation that refreshes each billing cycle.

  • Unused credits may roll over to the next month up to your plan's rollover limit (5 for Standard, 10 for Premium).
  • Credits are non-transferable and have no cash value.
  • Additional credit packs may be purchased as one-time add-ons.
  • If your subscription lapses, rolled-over credits will expire after 30 days.

6. Free Trial

New users receive a 14-day free trial with 12 credits. No credit card is required to start a trial. After the trial period ends, your account will be frozen until you subscribe to a paid plan. Your vocabulary, progress, and saved content will be preserved.

7. AI-Generated Content

The Service uses artificial intelligence to generate reading passages, definitions, grammar explanations, images, and audio. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or inappropriate material.

  • AI-generated content should not be relied upon as the sole reference for language learning or any other purpose.
  • We do not guarantee the accuracy, completeness, or appropriateness of any AI-generated content.
  • You should verify important information from authoritative sources.

8. User Content and Data

You retain ownership of any content you create or upload, including vocabulary lists, notes, and study data. When you share passages to the community library, you grant Imbue Lang and other users a non-exclusive license to view and use that content for language learning purposes.

You are responsible for ensuring that any content you share does not violate applicable laws or third-party rights.

9. Acceptable Use

You agree not to:

  • Use automated scripts, bots, or scrapers to access the Service or extract content.
  • Share your account credentials with others.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Abuse the content generation system (e.g., generating content for purposes unrelated to language learning).
  • Use the Service to generate harmful, offensive, or illegal content.
  • Circumvent or attempt to circumvent any usage limits, security measures, or access controls.

10. Intellectual Property

The Imbue Lang platform, including its software, design, branding, and documentation, is owned by Imbue Lang and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial language learning purposes.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

12. Termination

You may delete your account at any time through your account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the Service. We will provide notice of termination when reasonably possible.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy of AI-generated content or that the Service will meet your specific learning objectives.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMBUE LANG'S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO IMBUE LANG IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL IMBUE LANG BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.

16. Changes to Terms

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
